2. Products and Unique Variations
- Upcycled Nature: Our products are crafted from reclaimed materials. You acknowledge that items naturally feature unique textures, fading, marks, or stitching variations. These are deliberate characteristics of upcycled fashion, not defects.
- Color Accuracy: We display our product colors as accurately as possible. We cannot guarantee that your computer monitor or phone screen will display colors perfectly.
- Availability: We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction on a case-by-case basis.
3. Accuracy of Pricing and Billing
- Price Changes: Prices for our products are subject to change without notice.
- Pricing Errors: In the event that a product is mistakenly listed at an incorrect price due to a system glitch, we reserve the right to refuse or cancel any orders placed for the product listed at the incorrect price, even if the payment has been processed. If payment was made via M-Pesa or card, we will issue a full reversal.
- Right to Refuse Orders: We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person or per order.
4. Third-Party Logistics Liability
- Logistics Services: Shipping is handled entirely by independent, third-party logistics networks (including Pick-up Mtaani and independent on-demand delivery app operators).
- Liability Boundaries: Once a parcel is handed over to a delivery rider or checked into a Pick-up Mtaani station, [Your Store Name] is not legally responsible for courier operational delays, agent closure hours, system notification glitches, or package transit damage.
- Unclaimed Parcels: Customers are responsible for picking up their orders from Pick-up Mtaani agents within the timeline specified by Pick-up Mtaani’s standard storage terms. We do not offer store credit or compensation for packages abandoned at agent locations.
5. Intellectual Property and Content Ownership
- Our Original Assets: All original content included on this site—such as our specific product photographs, brand logos, website design, graphics, and written text—is the exclusive property of Swan Reclaimed and is protected by Kenyan and international copyright laws. You may not download, copy, or reuse our product photos or marketing materials to sell your own items.
- Design Inspiration: Many of our upcycled products are hand-crafted interpretations inspired by shared sustainable fashion concepts, public tutorials, and global upcycling trends. We claim ownership over our specific physical creations, material combinations, and brand assets, not the foundational crafting techniques or publicly available design concepts themselves.
6. Governing Law
- These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Republic of Kenya.
